Hurricane Florence

Good afternoon -

Many of you have experience with dealing with disasters and as we watch the path hurricane Florence is taking we wanted to reach out to see if any of you would be available to act as a resource for our colleagues who will be impacted by this storm.  We will be sending a note to our membership about IMLA's resources on this subject and depending on what happens, will likely be planning a call for next week sometime to help communities impacted by the hurricane.

Please get in touch with me if you are willing to participate in a call next week with communities impacted by the disaster and we can try to coordinate as many of your schedules as possible.

Also, if you have any suggestions for communities on things they should do now / before the storm hits in anticipation of the disaster, please share those suggestions (to the extent they are feasible in the next day or two) and we can pass them along to the impacted communities. I'm sure many of the members who will be most impacted may have already evacuated but there may be some things they can still do before the storm hits.

Yes, I'm available.  If I can't join the call,  I can get a colleague to participate.

Biggest tips - back up their files and documents somewhere that they can get them no matter what (so double and triple redundancy - put them on a thumb drive and take it with them, put in in the Cloud, etc.).  Also, having the names and contacts (including cell phones) of not only their staff but anyone they may need to call in other jurisdictions, such as the state or other cities if they need to request quick mutual aid or to draft a mutual aid agreement in the immediate aftermath or vendors they might need to call upon.

I would also suggest they go 2 or 3 layers deep on the contacts. For example, in case the main contact loses power and cannot respond or is severely impacted and can't help, having that person's back up was very helpful.

Yes, I'm available.  If I can't join the call,  I can get a colleague to participate.

Biggest tips - back up their files and documents somewhere that they can get them no matter what (so double and triple redundancy - put them on a thumb drive and take it with them, put in in the Cloud, etc.).  Also, having the names and contacts (including cell phones) of not only their staff but anyone they may need to call in other jurisdictions, such as the state or other cities if they need to request quick mutual aid or to draft a mutual aid agreement in the immediate aftermath or vendors they might need to call upon.

Many of you have experience with dealing with disasters and as we watch the path hurricane Florence is taking we wanted to reach out to see if any of you would be available to act as a resource for our colleagues who will be impacted by this storm.  We will be sending a note to our membership about IMLA's resources on this subject and depending on what happens, will likely be planning a call for next week sometime to help communities impacted by the hurricane.

Please get in touch with me if you are willing to participate in a call next week with communities impacted by the disaster and we can try to coordinate as many of your schedules as possible.

Also, if you have any suggestions for communities on things they should do now / before the storm hits in anticipation of the disaster, please share those suggestions (to the extent they are feasible in the next day or two) and we can pass them along to the impacted communities. I'm sure many of the members who will be most impacted may have already evacuated but there may be some things they can still do before the storm hits.

Good afternoon, Amanda.

The Louisiana Municipal Association and I will offer whatever assistance may be useful to the members affected by Florence.

Most agencies will be completely overwhelmed and having difficulty just prioritizing immediate needs and requests to preserve life, safety, health and property for several days and, for some, even weeks.  With those concerns being the priority it may be difficult to focus on assistance programs,  federal disaster program eligibility, and damage documentation requirements for reimbursement.

For those who have the time and ability to take some useful immediate steps to maximize reimbursement in the future, the following may provide a limited guide:

  • Think of FEMA Public Assistance as an insurance policy that provides for reimbursement of eligible damages limited to pre-storm condition
    *  Your "policy and coverage" limitations are the provisions in the Stafford Act - these are not FEMA options
    *  You will have to file a "claim" in which YOU have to demonstrate the condition of the facility before the storm hits
    *  Photographs, maintenance records, and a specific damage report will have to be completed and a "claims adjuster" (Public Assistance Program Inspector) will review and document the accuracy of your claim
  • Emergency contracting for debris removal, emergency repairs, and potentially FEMA eligible work has to follow local, state and federal rules
    *  No sole source contracts
    *  Demonstrable effort to have fair and open bids through normal RFP process even if expedited for emergency needs
    *  If only one responsive bid is received it may be acceptable but contact the State emergency management agency Public Assistance Program Lead, State Coordinating Officer, or Disaster Recovery Manager before making the award to assure eligibility will not be denied.
    *  Costs must be reasonable and justified - will be audited
  • Force account labor and equipment (to include overtime, benefits, etc) are generally allowable but must be tracked and reported in a way that establishes relationship to the disaster and will be audited.
  • Don't assume "someone" (county or state) will be reporting damages to a local municipality road, bridge or infrastructure item.  Roads and bridges have different Federal emergency assistance paths through the Federal Highway Administration and FEMA.  Report and document all damages to roads and bridges to the State Department of Transportation to maximize and expedite recovery and reimbursement.  Most local municipalities have Federal Aid Routes that only FHWA can process - reporting these routes to FEMA will delay repair/reimbursement for months or even years.
  • Damage to roads and bridges used for debris hauling routes are potentially eligible disaster damages even if the damage  is identified weeks or months later.
    *  Debris trailers and crane equipment with high pressure point outrigger stability plates is often much, much heavier than roads (particularly neighborhood roads) are designed for
    *  Create a roster of official debris haul routes
    *  Document current condition even after the storm has passed and water drains away.
    *  Monitor for damage periodically as long as debris hauling operations are underway

Great information so far! To go a step further on the debris removal/pre-positioned contracts, I suggest that you call the vendors today, if you haven't already done so. Get their back up numbers and contact information in case their company phones/servers are impacted. Also, discuss mobilization time and remind them if their contract has a required response time. Establish who is supposed to/authorized to make the call to activate/direct the vendors.

I'm attaching a slide that is actually adapted from a presentation we submitted to Amanda for next month's IMLA conference with input from my co-presenters, Robin Jones Jackson and Catherine Ures.  I know all three of us are available to help and will make every effort to participate in the call next week.

Thanks to all of you who have volunteered to help.  I reached out to the General Counsel with the North Carolina League of Municipalities to get her sense of when our help would be most welcome.  What she said is in line with what I was thinking in terms of when we should schedule a call.  Specifically she said: “the eastern part of the state is devastated.  We expect flooding in more areas over the next few days as the rivers crest, so I’d definitely suggest waiting until the end of the week.”

Let’s look to do something on Friday or Monday of next week once the actual imminent threat has passed.

Thanks to all of you who have volunteered to help. I reached out to the General Counsel with the North Carolina League of Municipalities to get her sense of when our help would be most welcome. What she said is in line with what I was thinking in terms of when we should schedule a call. Specifically she said: “the eastern part of the state is devastated. We expect flooding in more areas over the next few days as the rivers crest, so I’d definitely suggest waiting until the end of the week.” Let’s look to do something on Friday or Monday of next week once the actual imminent threat has passed.
