In Romero, the employee did consent (albeit not in writing) to the testing and the court said that he did so because he would otherwise lose his job so basically he was forced to test.  So, I'm not sure consent matters.

Does Romero apply if the municipality makes consent to random drug testing a condition of "volunteer" firefighter status?

OML was pushing some legislation a couple years ago but I think it fizzled out.

The problem is that if they do test volunteers (especially randomly), then it is a 4th amendment violation according to Romero v. City of Miami.

Group,

I have a municipality that is setting up random testing on those employees who deal with safety equipment/issues. Would it be legal to test the volunteer  fireman as well?
