Mr. Thompson,

In Texas, the procedure for involuntarily isolating/quarantining a citizen is covered by Chapter 81 of the Health and Safety code. If voluntary compliance with control measures does not work for a particular individual, the City (the Local Health Authority) is able to seek court intervention to mandate compliance. This is covered by Subsection G of Chapter 81 of the Texas Health and Safety Code. The Public Health Department keeps the City's Law Department updated when there is an individual who is implying that he will not comply voluntarily with control measures. Certain timelines and requirements are waived during a public health emergency. If the case progresses to needing court intervention, we file the below documents with the court-first seeking emergency protective custody to hold the person while the court proceeding is ongoing.

  1. File and Original Petition with Application for Court Orders for the Management of a Person with a Communicable Disease;
  2. File a Motion for Order of Protective Custody;
  3. File a Writ of Commitment, along with an Order of Protective Custody and Writ of Commitment
  4. File a Notice of Hearing

The process is almost exactly the same as the process for seeking court orders to management the treatment of individuals with tuberculosis, which is something many city law departments may have dealt with in the past. During the process, we would request that the Court appoint an attorney ad litem for the citizen. There needs to be a fact finding hearing in order to address due process concerns. The whole process requires close work with the Public Health, as they are needed every step of the way to locate an area where the person will be ordered to stay, to sign required affidavits for the court documents, and ultimately to testify at the due process hearing. Once we are granted a Court Order for Management of a Person with a Communicable disease the person is moved to the location where the court ordered them to remain. We are hopeful that all of the above-mentioned proceeding would move quickly and swiftly. There have been specific Judges appointed by the Texas Supreme Court to be available to handle these cases quickly. I believe that a Judge or Judges have been appointed for each county, so each Texas county should look into who that specific Judge is for quick reference. I'm not sure if this helps, but we are standing by with the sample motions/orders on hand for if ever needed. Thank you.
