A member poses the following: In an April 17, 2023 opinion, the Ninth Circuit held that a Berkely, CA ordinance prohibiting installing natural gas piping within newly constructed buildings was preempted by the Energy Policy and Conservation Act ("EPCA"), 42 U.S.C. §6297(c). See California Restaurant Association v. City of Berkeley ___ F.4th ___ (2023) (9th Cir.). As a potential option to address the preemption issue, we are inquiring about other jurisdictions that may have adopted energy consumption or conservation objectives intended to fall under the building code exception provided in EPCA.
