Question on preemption of natural gas prohibition

A member poses the following:
In an April 17, 2023 opinion, the Ninth Circuit held that a Berkely, CA ordinance prohibiting installing natural gas piping within newly constructed buildings was preempted by the Energy Policy and Conservation Act ("EPCA"), 42 U.S.C. §6297(c).  See California Restaurant Association v.
