Dear IMLA COVID-19 Working Group:

I am sure you all saw the news yesterday that President Biden is mandating all employers with over 100 employees to require their employees to get vaccinated or tested weekly.  I am in the process of trying to determine if this will apply to public employers.  My understanding is that this is being promogulated through OSHA.  I am attaching the white house's action plan which was released yesterday and contains the following regarding vaccine mandates: "Requiring All Employers with 100+ Employees to Ensure their Workers are Vaccinated or Tested Weekly: The Department of Labor's Occupational Safety and Health Administration (OSHA) is developing a rule that will require all employers with 100 or more employees to ensure their workforce is fully vaccinated or require any workers who remain unvaccinated to produce a negative test result on at least a weekly basis before coming to work. OSHA will issue an Emergency Temporary Standard (ETS) to implement this requirement. This requirement will impact over 80 million workers in private sector businesses with 100+ employees."

Because OSHA applies to private employers, it may be that this rule will not apply to state/local governments.  However, 22 states have adopted a state OSHA Plan that covers private and state/local government workers and 6 states have approved an OSHA plan that covers state and local workers only.  Here's a map of which states have state covered OSHA plans: https://www.osha.gov/stateplans

It is therefore possible that this rule will apply to state and local government employers, perhaps only those with a state adopted OSHA plan.  As soon as I have more information on this, I will share it.  If anyone has seen any documentation as to whether this is going to apply to state and local government employers, please send it to me and I will share with the group.
