General assumption around my neck of the woods is that it applies to all health department health care workers and all EMTs. Jail doc/nurses makes sense- based on who receives Medicare/Medicaid.
That EO for health workers has no testing option. I think how to treat exemptions will be important.
No deadline established yet by CMS to my knowledge.

In the meantime, here are a few documents that came up on today’s call that I wanted to circulate:
- Here is the Sixth Circuit opinion involving Western Michigan University (public university)’s vaccine mandate for its student athletes. As noted on the call, the court concluded the University’s policy was not generally applicable under Fulton v. City of Philadelphia / Employment Division v. Smith because it allowed for the opportunity to provide exemptions (religious and medical) and therefore, the University would need to meet strict scrutiny to withstand the students’ free exercise challenge. The court concluded on an appeal from a grant of a preliminary injunction in favor of the students that the University was unlikely to succeed on the merits and therefore upheld the injunction. https://www.opn.ca6.uscourts.gov/opinions.pdf/21a0234p-06.pdf
