In the meantime, here are a few documents that came up on today's call that I wanted to circulate: * Here is the Sixth Circuit opinion involving Western Michigan University (public university)'s vaccine mandate for its student athletes. As noted on the call, the court concluded the University's policy was not generally applicable under Fulton v. City of Philadelphia / Employment Division v. Smith because it allowed for the opportunity to provide exemptions (religious and medical) and therefore, the University would need to meet strict scrutiny to withstand the students' free exercise challenge.
