I thought this was quite helpful, but my finance department looked at it and is asking me to point to the specific part in the law that states that it applies to local government, as they are not seeing it in the act.  Any direction from anyone?  Thanks!

Regarding the applicability of the expanded FMLA provisions in the new Act, pls see:

  •   Section 101(4)A(i) of the Family and Medical Leave Act of 1993, which is amended in the new Act and referenced in Division C of the Act - applies to private employers
    
  •   Sec. 101(4)A(iii) of the Family and Medical Leave Act of 1993, which is not amended in the new Act, - applies to public employers (see section 3 of the Fair Labor Standards Act of 1938 referenced in the FMLA re the definition of employer, which includes a state, political subdivision of a State ...)
    

The expanded FMLA provisions of the new Act apply to public employers.

Here’s what I sent to a client:

The Town is required to pay employees under the new federal Families First Coronavirus Response Act. The town has always been subject to the federal medical and family leave act but up to now that law only required that leave be unpaid. The new Act applies to all employers covered by the current FMLA. The current FMLA includes as employer any “public agency” as defined in section 3(x) of the Fair Labor Standards Act. Section 3(x) of the FLSA defines “public agency” to include the government of a political subdivision of a state regardless of number of employees.

Here’s what I sent to a client: The Town is required to pay employees under the new federal Families First Coronavirus Response Act. The town has always been subject to the federal medical and family leave act but up to now that law only required that leave be unpaid. The new Act applies to all employers covered by the current FMLA. The current FMLA includes as employer any “public agency” as defined in section 3(x) of the Fair Labor Standards Act. Section 3(x) of the FLSA defines “public agency” to include the government of a political subdivision of a state regardless of number of employees. I want to make sure I am really understanding Section 7005.  That means that the wages are not subject to the employer only portion of Social Security but what exactly does or "compensation for purposes of section 3221(a) of such Code." mean?  3221(a) is the broad definition of wages.

Amanda, I don’t have an informed answer, but only a general guess, and it may depend on your state’s law. If the compensation does not constitute wages and your state does not have a different definition of wages than federal law, then that may mean that failure to pay on time is not a violation of the wage and hour laws (state or federal) and perhaps the pay is not part of the calculation of wages for pension purposes. But someone else may have a better idea.
