When privileged attorney-client materials are withheld from documents made available for inspection and duplication pursuant to an ORA request, do you include any kind of privilege log?

I have not done a formal privilege log unless we are in a court setting such as a subpoena. However, I can see that this may be a best practice. I have in the past indicated that privileged information was being withheld.

I am unaware of any requirement to provide a privilege log under the open records act. If there is litigation pending, I would require discovery through the litigation process not the ORA.
