Rule 1.6 prevents lawyers from revealing information protected by the attorney-client relationship and the new ABA Opinion extends that obligation to listservs. Both the Rule and the Opinion are aimed at restricting the dissemination of information that could reveal attorney-client protected information. Opinion 511 discusses a 1988 ABA Formal Opinion which provides guidance on how attorneys can continue to utilize IMLA’s listservs without violating Rule 1.6. ABA Formal Opinion 98-411 (1988), explained that “a lawyer is impliedly authorized to consult with an unaffiliated attorney in a direct lawyer-to-lawyer consultation and to reveal information relating to the representation without client consent to further the representation when such information is anonymized or presented as a hypothetical and the information is revealed under circumstances in which ‘the information will not be further disclosed or otherwise used against the consulting lawyer’s client.’” While Opinion 511 goes on to explain that the 1988 Opinion did not extend to listservs, the Opinion does not contemplate how IMLA members typically use the IMLA listservs and which IMLA believes abides by Opinion 98-411. Furthermore, posting non-confidential information to the listservs is already permissible and may continue (sharing legal updates and other publicly available information). We believe it is important for all attorneys to abide by their ethical obligations under Rule 1.6 and individual attorneys should feel free to consult with their state ethics commissions or other ethical bodies for further information on this.
