Defense to lawsuits brought to invalidate COVID public health measures
A member is facing a class action lawsuit by businesses claiming the City has no authority to issue its COVID public health measures (i.e., rules that call for wearing face coverings, maintaining 6 foot distances, limiting the number of people in a business). The plaintiffs have included a claim under 42 USC §1983. The member is wondering if anyone that has faced such a challenge (doesn't have to be a class action) has defended on the ground of either sovereign immunity or qualified immunity. A member is facing a class action lawsuit by businesses claiming the City has no authority to issue its COVID public health measures (i.e., rules that call for wearing face coverings, maintaining 6 foot distances, limiting the number of people in a business). The plaintiffs have included a claim under 42 USC §1983. The member is wondering if anyone that has faced such a challenge (doesn't have to be a class action) has defended on the ground of either sovereign immunity or qualified immunity. A member is facing a class action lawsuit by businesses claiming the City has no authority to issue its COVID public health measures (i.e., rules that call for wearing face coverings, maintaining 6 foot distances, limiting the number of people in a business). The plaintiffs have included a claim under 42 USC §1983. Subject: [Disasterrelief] Defense to lawsuits brought to invalidate COVID public health measures
A member is facing a class action lawsuit by businesses claiming the City has no authority to issue its COVID public health measures (i.e., rules that call for wearing face coverings, maintaining 6 foot distances, limiting the number of people in a business). The plaintiffs have included a claim under 42 USC §1983. The member is wondering if anyone that has faced such a challenge (doesn’t have to be a class action) has defended on the ground of either sovereign immunity or qualified immunity.
