Good morning:
I am attaching the complaint filed by San Francisco and Santa Clara County against the Trump administration last night seeking to enjoin enforcement of the executive order "Protecting American People Against Invasion" and the DOJ memo that would seek to withhold federal funds from "sanctuary jurisdictions." The complaint alleges that the defendants' actions violate the Tenth Amendment, Separation of Powers, Spending Clause, Due Process Clause, and the Administrative Procedure Act. The plaintiffs seek, among other things, a declaration that Section 17 of the Executive Order is unconstitutional and invalid on its face and a preliminary injunction enjoining the Defendants from enforcing Section 17 or taking "any other action in furtherance of any withholding or conditioning of federal funds based on Section 17 of Executive Order 14,159 or taking enforcement actions against Plaintiffs based on the laws and policies identified in this complaint."; and "A preliminary and permanent injunction enjoining Defendants from implementing the funding pause or the unlawful funding conditions directed by the Bondi Memo, or taking enforcement action against Plaintiffs based on the laws and policies identified in this complaint;".
I understand from San Francisco that they are able to accept additional plaintiffs if you would like to join this effort as they may be able to submit an amended complaint with additional plaintiffs.
