At our last meeting we discussed reaching out to the ABA so that IMLA could comment on proposed rules and raise issue with the ABA regarding the model rules.  I reached out and will report on the response.  We have two interesting topics to discuss originating from a Maryland disciplinary action and a recent California ethics opinion.  The Maryland case is Attorney Grievance Commission v. Stanalonis, decided Nov 23, 2015 and discusses how the Model Rules apply to an attorney who is campaigning for a judicial office and the extent to which campaign statements may violate the Rules.  The California opinion 2015-194 discusses the California Rules regarding truthfulness as applied to attorney statements during the course of litigation, mediation and negotiations.  It's a very well written and thoughtful analysis that I think would support similar analysis under the Model Rules.  If you have something you want to discuss during the call, that is why we have the calls, so feel free to raise the issue tomorrow.  The dial in for the call is 1-888-346-3659 and the pin is 2024#.
