Bevilacqua 2022 ONSC 2065: An Expensive Frivolous Litigation This presentation will discuss allegations of misappropriation of special interest funds, threats of personal liability, conflicts of interest, loss of council quorum, accusations of criminality .... all of which ended with a dismissal and $1M+ substantial indemnity costs awarded against the plaintiff. Wendy Law & John Mascarin An Ontario Perspective on Nelson (City) v. Marchi 2021 SCC 41 This presentation will discuss the nature and significance of the policy decision immunity holding in Marchi. The presenter will also discuss the significance of Marchi in statutory duty jurisdictions v. common law duty jurisdictions. David Boghosian Indigenous Relations The panelists will address several topics related to Indigenous relations. The first presentation will explore the legal requirements and practical considerations for developing mutually agreeable outcomes with Indigenous communities. What are the legal rights of Indigenous communities in relation to municipalities? What roles do municipalities have in reconciliation? Is there is a higher path that municipalities can take to build long-lasting relationships with their Indigenous neighbours? The second presentation will discuss Toronto's relationship with First Nations adjacent to Green Lane Landfill including Agreements and Opportunities; and the third presentation will discuss the City of Saskatoon's many urban reserve agreements, experiences, and best practices. Scott Pasternack, Ian Duke, Brent Lehmann & Jodi Manastyrski Issues and Implications: How Prompt Payment and Adjudication Are Playing Out Across Canada A discussion of how prompt payment rules and new adjudication processes are being adopted for construction projects across Canada, with a focus on what the Ontario experience has been so far. The panelists will explore the challenges created by these recent developments and provide tips on how best to manage them. Michele Wright & Glenn Ackerley Ethical Lawyering in a (Post?) Pandemic World This presentation will discuss considerations relevant to changes in the practice of law arising from the pandemic. This includes the duties of lawyers as advocates in the online world (i.e., with the proliferation of Zoom hearings and CaseLines). It will also include discussion on Chapter 3 of the Rules of Professional Conduct (i.e., competence, confidentiality, and quality of service). The presentation will also discuss larger societal issues regarding equity, diversity, and inclusion.
