IMLA has determined to file an amicus brief in an important government speech case to be heard by the Supreme Court. Several years ago, IMLA surveyed local governments in a case in which the Supreme Court declared that governments have the right to speak and to determine what to say as well as what not to say. Pleasant Grove City vs. Summum. The case before the Court may well jeopardize the extent to which governments can determine what not to say and what to say in specific instances. To help us present the issue to the Court as clearly as possible we hope that you will respond to this survey. We want only one response from a municipality, so please coordinate within your municipality as to who will be answering on your behalf. We use the term municipality broadly to cover all units of local government. So, if you have separately independent school boards for example, please get them to respond as well.
