Following-up on a couple of items from today's call.  First, here is a link to New York City's directive requiring employees to wear face coverings except those who provide documentation that they are fully vaccinated against COVID-19 (with some exceptions to certain city employees): https://www1.nyc.gov/assets/dcas/downloads/pdf/agencies/directive_2020_1.pdf

I am also passing along some case citations NYC provided with regard to the questions on Fourth Amendment issues related to testing:

  • Knox County Eudc. Ass'n v. Knox County Bd. Of Educ., 158 F.3d 361 (6th Cir 1998)
  • Makas v. Miraglia, 2010 U.S. Dist. LEXIS 86461 (S.D.N.Y. August 18, 2010)
  • Maryland v. King, 569 U.S. 435 (2013)
  • Vernonia Sch. Dist. 47J v. Acton, 515 U.S. 646 (1995)

Finally, here is the Seventh Circuit's decision which came out yesterday in Klassen v. I noticed on Amanda's spread sheet that Kansas City, MO requires testing and will accept proof of vaccine in exchange.

Does anyone have a copy of Kansas City's policy that they are willing to share?

I would also be interested in knowing if the "no vaccine required" positions/policies have changed in the last 2 months (aside from Denver and NYC that we already discussed) to require vaccines for all employees or a specific sector of public employees, like public safety.  And if so, would they share their policies and any lessons learned/litigation claims, etc.
