Temp checks of public upon re-opening

All - is anyone taking the temperature of the public as part of their re-opening plan?  If so, have you found legal support for this?  I know the question of taking the public's temperature has gone around a few times in this group, but I can't locate a definitive answer.  We are currently taking temps of employees and job applicants, but are closed to the public right now.  We are looking into temp checks of the general public upon re-opening.

Could you let me know what you are relying on to take temps of job applicants? I posted something about this a few weeks ago looking for authority to do that and only have found EEOC authority saying you cannot take temperatures of job applicants, until they have a conditional offer of employment.

16. If an employer is hiring, may it screen applicants for symptoms of COVID-19?
Yes. An employer may screen job applicants for symptoms of COVID-19 after making a conditional job offer, as long as it does so for all entering employees in the same type of job. An employer may screen job applicants for symptoms of COVID-19 after making a conditional job offer, as long as it does so for all entering employees in the same type of job.  This ADA rule allowing post-offer (but not pre-offer) medical inquiries and exams applies to all applicants, whether or not the applicant has a disability.

    1. May an employer take an applicant's temperature as part of a post-offer, pre-employment medical exam?
      Yes.  Any medical exams are permitted after an employer has made a conditional offer of employment.  However, employers should be aware that some people with COVID-19 do not have a fever.

Laura - we have job applicants fill out a questionnaire that requests their consent to have their temperature taken. If they don't consent, we simply re-schedule their interview to a later date - though that has not happened yet.  Because the EEOC guidance was not exactly on point, we decided that this was the best way to proceed.
