One last point of clarification before today’s call.  I spoke to Terri and her background is on the enforcement side, so she will address the portions of the paper that are focused on local governments’ ability to enforce health and safety laws for businesses that are reopening and ways to address unsafe working conditions as businesses reopen in your communities.   We can have someone else on (and Terri has some suggestions) who can discuss the perspective of the local government as the employer.

Terri Gerstein, the Director of the State and Local Enforcement Project will be joining us on today’s COVID-19 working group call to discuss the workplace safety briefing her organization and NELP jointly put out and which I circulated last week (see below).  I asked her to talk to the group for 10-15 minutes about this and then she can answer questions, if you have any. 

 

We will still have plenty of time for our regular discussion and Q&A regarding other issues you are facing.  But given that many localities are considering reopening plans for employees, we thought this would be a helpful discussion.

The Harvard Labor and Worklife Program and the National Employment Law Project (NELP) have jointly issued a briefing on what states and localities can do to protect workplace safety and health.

 

The briefing:

 

- Outlines key elements of the Occupational Safety and Health Act; 

- Provides a legal analysis of when OSHA does and does not preempt state or local legislation or action; and 

- provides specific examples of how states and localities can protect workers during the Covid-19 pandemic.
